Lubanga Trial: December and February in Review

In December …
On December 1, ‘witness 598′ testified in a closed session, although it is thought that the witness testified about the “climate of fear” in Bunia among those who are publicly known to have cooperated with the ICC. After this testimony, the Trial Chamber heard the defense’s request for a dismissal of trial due to allegations of abuse of process. The rest of the week was held in closed session.

On December 13, the Court allowed the prosecution’s request to “withhold the identity of ‘intermediary 273’ because ‘the information provided by the prosecution regarding this individual does not appear to have any significance in the present case.’”

In February …
On February 23, Judges rejected the defenses request made in December to have the trial dismissed, but did not say why.  In response defense attorney, Catherine Mabille told the Court, “I believe the chamber knows we had a very short time period to analyze the decision that has been handed down, and we would like to inform the chamber that were not able to discuss with our client, and given the possible appeal, we are not in position right now to see whether we are ready.”
